What a Judge Ordered an Active Duty Sailor to Do or Risk Losing Custody of His Daughter is Obscene

6/22/2014

Circuit court Judge Margaret Noe has ordered Matthew Hindes to appear in court on Monday, or risk losing full custody of his daughter.
Minor issue: Matthew Hindes is in the U.S. Navy, and is currently stationed on a submarine deployed in the Pacific Ocean.
Hindes has had full custody of his daughter since 2010. He received full parental rights when his daughter was taken from his ex-wife by Child Protective Services.
At the present time, his daughter is with his current wife, Benita-Lynn - her step-mom while her dad’s away. In most cases, Hindes would be protected by the Service Members Civil Relief Act which provides safeguards for active duty military members in civil judicial proceedings.
But Judge Noe doesn’t agree and has said, “If the child is not in the care and custody of the father, the child should be in the care and custody of the mother.”
In addition, Noe has issued a warrant for Hindes’ arrest. Hindes’s wife Benita-Lynn said of the incident:
“He’s protecting the rights of others, but who is protecting his rights?”
In situations like these, we can only hope someone informs Judge Noe of the ludicrous nature of her ruling, and Hindes is able to maintain full custody of his daughter.
UPDATE: The Facebook page of Justice for the Hindes Familyhas posted a petition on change.org. It is currently 1,500 signatures short of its goal.
