The man shot and killed by a U.S. deputy marshal in Albuquerque previously served time for smuggling undocumented immigrants across the border and for vehicular homicide.

The family of 27-year-old Anthony Jacob Chavez identified him as the man killed in the shooting on July 2. According to his obituary, Chavez is survived by his wife, Monique, and two children, ages 8 and 10.

The U.S. Marshals Service told KOB last week they were attempting to serve a federal arrest warrant near 98th and Dennis Chavez when a deputy marshal discharged an agency-issued firearm, "resulting in the death of the fugitive."

Marshals did not identify the person killed in the shooting and did not say whether the fugitive was armed.

Chavez was charged in August 2010 with bringing undocumented immigrants into the country. He pleaded guilty and served six months in prison before getting out on release. However, court documents show Chavez violated his conditions of release by failing drug tests.

In May 2013, Chavez was arrested and charged with vehicular homicide after getting into a fatal crash in the South Valley. A Bernalillo County deputy said Chavez admitted to checking his cellphone before crashing into 24-year-old Christian Gurule, who died after the incident.

Vehicular homicide, a violent felony charge, was also a violation of his conditions of release from prison.

Funeral services for Chavez will be held on Wednesday in Deming, where he was born.
