HARRISBURG, Pa. (AP) – Lawyers for Pennsylvania’s attorney general say the judge who supervised a grand jury that’s recommended charges against her should be removed from any future proceedings in the matter.
Attorney General Kathleen Kane’s legal team argued in a filing with the state Supreme Court on Monday that Montgomery County Judge William Carpenter has demonstrated personal animosity toward her.
The latest filing comes about a week after Carpenter defended the legality of his appointment of a special prosecutor to investigate allegations that secret grand jury material was leaked to a Philadelphia newspaper last year.
The grand jury recommended charges against Kane that include perjury.
Kane’s lawyers accuse the special prosecutor of an unlawful assumption of executive power, and say Carpenter didn’t have the power to appoint him. Kane hasn’t been charged.
