U.S. to allow some immigrant deportees to return under settlement

9/2/2014

FORWARD: Twisted U.S. Constitution becomes a tool to clear pathway for illegal immigrants. Establishing goal of no  longer protecting U.S. sovereignty and the rule of law.
A group of local residents carrying flags and posters assist in turning away three buses carrying immigrant detainees to a Border Patrol station in Murrieta.

Immigrant detainees

Homeland security officials will not use threats and intimidation against immigrants facing possible deportation, and will allow some — perhaps thousands — with ties to Southern California to return under an agreement announced Wednesday. The government admitted no wrongdoing in the settlement, which came in response to an ACLU lawsuit filed last year, but it agreed to take several measures to protect migrants' rights.

The agreement covers only Southern California, but some of the reforms in the deportation process are likely to be adopted nationwide, U.S. Immigration and Customs Enforcement officials said.

It was unclear how many people might be allowed to return under the agreement, but advocates estimated that it would be a small fraction of the 250,000 deported voluntarily from Southern California between 2009 and 2013, the period covered in the lawsuit.

Although critics called Wednesday's announcement yet another Obama administration move to mollify immigrant advocates at the expense of border security, American Civil Liberties Union leaders said the changes would result in a fair process that protects immigrants' rights.

"This is a historic settlement that will end a practice that tears families apart," said Norma Chavez Peterson, executive director of the ACLU of San Diego and Imperial counties.

In its lawsuit, the group alleged that federal agents in recent years had turned to intimidation, threats and misinformation to persuade immigrants in this country illegally to agree to voluntary deportation. Many deportees were longtime California residents with no serious criminal records who didn't know that they could challenge their deportations in court, according to the lawsuit.

Among the reforms the settlement requires: Federal agents will be prohibited from using threats or pressure. They must advise people of their right to a hearing and provide them access to an informational hot line and a list of free legal service providers.

The settlement also calls for the United States to launch an outreach effort through Mexican media, aimed at informing deportees that they may be eligible to return if they are part of the settlement class.

Homeland security officials said in a statement that coercion and deception by the two agencies that handle most removal proceedings, ICE and Customs and Border Protection, are "not tolerated."

"In an effort to address the issues raised in this litigation, both agencies have agreed to supplement their existing procedures to ensure that foreign nationals fully comprehend the potential consequences of returning voluntarily to Mexico," the statement readThe class of deportees who qualify for repatriation is limited mainly to longtime California residents with relatives who are U.S. citizens and to young migrants whose parents brought them into the country illegally.

The number of repatriations could reach into the hundreds or thousands, said Sean Riordan, senior staff attorney at the ACLU office in San Diego. All of those repatriated are potentially subject to deportation proceedings when they return.

So far, eight deportees have returned to California from Mexico, including 51-year-old Isidora Lopez-Venegas, who was deported after being stopped on the street in San Diego while walking with her U.S.-born children. She said agents threatened to place her autistic son in a foster home if she didn't agree to be deported.

In Mexico, Lopez-Venegas said during an ACLU news conference Wednesday in San Diego, she met other deportees with similar tales. "I became aware that there are many in my situation. It's very sad."

Critics called the settlement the latest in a series of policy shifts from the Obama administration designed to appease migrant rights groups. Some border agents dispute allegations of widespread abuse, saying homeland security officials are undermining their mission by allowing deportees to return to the U.S.

"At every turn, they're tying our hands," said Gabe Pacheco, a spokesman for the National Border Patrol Council, the union representing border patrol agents.

The Obama administration in recent years has worked to demonstrate its commitment to border security. Migrant advocates argue that agents resorted to abusive tactics to satisfy deportation quotas.

Among those represented in the ACLU lawsuit was a grandmother who was deported after being arrested at a bus stop and allegedly tricked into signing an English form that she couldn't read. One man said he was falsely told that his visa petition had been lost.

Many others weren't informed that once they left the U.S. voluntarily, they would be barred from returning for 10 years, the ACLU said."We kept hearing story after story from people … who had deep family ties, no serious criminal history — everything to lose by taking voluntary departure — who had been pressured into taking this instead of having their day in court," Riordan said.

UAW Boss Is ‘Confident’ Volkwagen Will Let Union In WITHOUT An Employee Vote

9/2/2014

UAW Foreign Cars Sign

Following the United Auto Workers’ stinging election defeat at trying to unionize Volkswagen’s in Chattanooga, TN earlier this year, the UAW has become more determined to unionize VW’s employees without letting a secret-ballot election take place.
A top United Auto Workers official said Friday that he’s confident Volkswagen will recognize Chattanooga Local 42 by bargaining with it as a members’ union.
“In the U.S. system, if you’re dealing with an entity, you’ve recognized it,” said UAW Secretary-Treasurer Gary Casteel.
….
Casteel, in a meeting with Times Free Press editors and reporters, said he thinks VW will bargain with Local 42 “over things that pertain to those members.”
Notwithstanding the fact that it was the same Gary Casteel who, earlier in the year, signed the “election agreement” with Volkswagen behind VW employees’ backs, it appears Mr. Casteel’s confidence may be a little shaky following the announcement that VW employees have begun organizing an independent union—without the UAW.

Follow-Up: Anti-UAW VW workers move to form own union

9/2/2014

The struggle over unionization at the Volkswagen factory in Chattanooga, TN, continues to get more complicated. There's now a second union fighting to organize at the plant; although this one is staunchly against the actions of the United Auto Workers. At the same time, the UAW is still signing up voluntary members to its recently created Local 42 at the facility and is reportedly near having a majority of the hourly employees on its side.

The new, anti-UAW union campaign is being spearheaded by employee Mike Burton, according to Reuters, and he calls his group the American Council of Employees. He claims to already have 108 signatures in support of his organization. Burton believes that the UAW is harmful to businesses, and his goal is to force another vote to determine a preferred union among workers.

The UAW was initially defeated (712 to 626) when it attempted a union vote at the Tennessee plant in February. However, UAW secretary-treasurer Gary Casteel told Reuters that Local 42 has already signed up over 700 members. If it can reach a majority of the roughly 1,500 employees, the group hopes VW might consider recognizing it as the factory's union.

VW's own labor leaders have supported unionization with the UAW in Chattanooga in the past as a means of getting it a seat on the company's Global Works Council. It's currently one of the company's only major factories in the world that isn't a member, but it needs an organized workforce to do it.

The political turmoil at the factory comes right before a major expansion. VW will build its new midsize, seven-passenger SUV based on the CrossBlue Concept in Chattanooga by the end of 2016. The new model will add about 2,000 new jobs and 538,000 square feet to the plant as part of a $900 million investment.

Global Warming Update: U S Govt puts Employees on Notice, Tells Them "No Farting at Work"!

9/2/2014

At this moment, there are muchos shenanigans going on in the Gubmint of the United States of America.

Over the course of the last few years, our Elected Dumbasses have seen fit to:

  • Assume control of your health care by taxing what's left of your ass off.
  • Sic the Bureau of Infernal Revenue on organizations and individuals with political leanings contrary to those of the Dumbass-in-Chief.
  • Reprimand a Gubmint employee for farting at work....
  • Say what?
  • Yep.
Best of Dumbass News

I am a simple man (cue Lynyrd Skynyrd). I have always been in awe of the things that so many people take for granted. Like the stars. We see them every night of our lives and over time they are kind of "just there" to most people. Not to me though. There's not a time I go outside at night and not think of the majesty of those seemingly tiny twinkling lights in the nighttime sky. Think about it for a moment. The star light you are looking at has traveled through the vastness of outer space for billions of light years and is just now visible to the human eye. In essence, you are looking back in time.

Another thing that simply amazes me are tomato seeds. I just can't wrap my mind around the fact that something so tiny can, when put into some dirt, watered and given the requisite amount of sunlight, produce a marvel of Nature like a big fat beefsteak tomato. How the hell does that work like that? I don't know and I don't care. All I know is that it does work and I ain't askin' questions.

Which brings us to farting.

A Real Gone Gasser

I am sure that it will come as no surprise to you that stories about farting are not new to Dumbass News. It was almost two years ago to the day that I wrote about the nation of Malawi's proposed law to ban farting under certain circumstances like: "insulting the modesty of a woman," "disturbing religious assemblies" and "trespassing on burial places". Pffffffffttttt!

Last summer I told you about a guy who threatened to shoot his neighbor for farting! This post is doubly entertaining as it also has a brief etymology of the word "fart".

While outlawing gaseous anal emissions and/or shooting another human bean because he broke wind may be a bit on the extreme side, being reprimanded for farting at work is not.

Hostile Work Environment

The U.S. Social Security Administration said it has rescinded a reprimand filed against an employee for creating a "hostile work environment" by passing gas.
The reprimand, which became public when it was posted on TheSmokingGun website, was filed against a worker accused by co-workers of creating a "hostile work environment" by continuously passing gas and releasing an unpleasant odor, The Washington Post reported Friday.

The agency said the reprimand has now been rescinded.

"When senior management became aware of the reprimand it was immediately rescinded," spokeswoman Dorothy Clark said.

The Social Security Administration did not offer a date for the rescinding action or respond to questions about the status of the employee.

The reprimand was filed by the agency's Office of Disability Operations and cited 60 occasions when the worker was accused of passing gas -- up to nine times per day -- in his office over the course of about 12 weeks.

The employee was described by TheSmokingGun as a 38-year-old man working at a Social Security office in Baltimore.

Is nothing sacred anymore?

When an employer can reprimand, or even possibly terminate, you because you exercise your Constitutionally-guaranteed (it falls under the "pursuit of happiness" or something) right to let one rip, then that employer must be held accountable!

Revolt!

Eat more beans!

Do not be silent! (but deadly)

Fart like there's no tomorrow!

Dumbasses.

Border Patrol Agent Shoots At Armed Militia Member In Texas

9/2/2014

Mission
When was the last time the border patrol lit up some illegals or the Mexican Army on American soil? Media setting the stage to discredit the militia.
The Border Patrol says an agent shot at someone near the Texas-Mexico border who later identified himself as a militia member.
Border Patrol spokesman Omar Zamora said that agents pursuing a group of immigrants east of Brownsville on Friday came upon a man holding a long arm near the river. An agent fired multiple shots but did not hit the armed man. The man then identified himself as a member of a militia.

National Post Recommends Converting To Islam To Avoid Islamic Terrorism

9/2/2014

uturn.jpg

I can understand the intent of the author. If the ability to recite a few lines of the Islamic declaration of faith saves your life, why not? Just because you say it, doesn't mean you must believe it.
On the other hand, spiritual and moral consequences aside, will capitulating to religious terrorists really make us any safer?
To weed the Muslims out from the infidels, terrorists asked people to recite the shahadah to prove their faith. They asked other things too, like certain key passages of the Koran, the name of Mohammad's mother, that sort of thing - it was al-Qaeda Question Hour. The wrong answer meant death. After that, many, myself included, wondered: Should we - Muslim or not - learn the basics of Islam and have a read through the Koran? If one of us ever finds herself in a situation similar to that of Westgate Mall victims, could even a rudimentary knowledge of Islam save us?

(Hat Tip: Jihad Watch)
Islam gives the kufar three choices during jihad: convert, submit, or die. If you convert under duress, isn't that the same as submitting? So, it really boils down to this - would you rather live on your knees or die standing?
I doubt any of us can definitively know what we would do while under attack by terrorists. How difficult would it be to recite a few words if you had a knife to your throat?
Robert Spencer's post is worth a read, as are the comments at the article itself.
