Who Can Sue For Defamation? In order to be actionable, a defamatory statement must be “of and concerning” the plaintiff. This means that a defamation plaintiff must show that a reasonable person would understand that the statement was referring to him or her. Of course, if a blog post or online article identifies the plaintiff by name, this requirement will be easily met. The plaintiff need not be specifically named, however, if there are enough identifying facts that any (but not necessarily every) person reading or hearing it would reasonably understand it to refer to the plaintiff.

A company or organization can be a defamation plaintiff. In fact, the largest jury verdict every awarded in a libel case came in a case brought by a business plaintiff.

Would-be Waffle House Robber himself, becomes a leaky waffle

Waffle House Patron Shoots Unsuspecting Armed Robber

On Monday morning, a robber walked into an Atlanta Waffle House and pointed a gun at patrons. The crook was wearing a bandana and hoodie, according to reports.

Everyone in the restaurant undoubtably saw their lives flash before their eyes. That is, until one Waffle House patron pulled out his own gun and fired at the bandit.

The suspect is Ashton Macafee, 20. After entering the Waffle House, he screamed. “Nobody move and open the cash register!” The incident happened around 2am in south Fulton County.

The man who fired back at Macafee, and likely saved the lives of some innocent patrons, was an off-duty security guard named Evans Chad Pollard. He fired two shots at Macafee, hitting him both times. Pollard said, “I felt that not only my life, but everyone’s life was in danger, so I had to do what I had to do. Everybody was scared and when I eliminated the threat, everyone felt calm. He came in and I did what I could.”

He continued, “As soon as he pointed [the gun] at us I’m like, I thought I was going to die right there.”

Pollard said he used to be a firefighter before becoming a security guard.

Macafee did not die as a result of the gunshots, but he is currently in critical condition in the hospital.

Thankfully, Pollard has not been charged with anything for shooting the crook. This man is a hero, and should be treated as such.

The totalitarian tip-toe is tap dancing to tyranny with the proposed Internet censorship bill in the United Kingdom. In the name of keeping children safe from porn, the UK law will impose Internet filters on far more than just porn.

According to Wired:

As well as pornography, users may automatically be opted in to blocks on "violent material", "extremist related content", "anorexia and eating disorder websites" and "suicide related websites", "alcohol" and "smoking". But the list doesn't stop there. It even extends to blocking "web forums" and "esoteric material", whatever that is. "Web blocking circumvention tools" is also included, of course.

The definition of "esoteric" makes clear that censorship of broad topics is the goal of this so-called ISP filter:

es·o·ter·ic [es-uh-ter-ik] adjective
1. understood by or meant for only the select few who have special knowledge or interest;
2. belonging to the select few.
3. private; secret; confidential.


Translation: anything outside the acceptable mainstream narrative will be filtered. In short, the free flow of information is under assault with this law.

The organization Open Rights Group refers to this totalitarian tip-toe as "sleepwalking into censorship":

What's clear here is that David Cameron wants people to sleepwalk into censorship. We know that people stick with defaults: this is part of the idea behind 'nudge theory' and 'choice architecture' that is popular with Cameron.

The implication is that filtering is good, or at least harmless, for anyone, whether adult or child. Of course, this is not true; there's not just the question of false positives for web users, but the affect on a network economy of excluding a proportion of a legitimate website's audience.

Open Rights also says the law could be used to play economic favorites, thus undermining the free market on the Internet:

There comes a point that it is simply better to place your sales through Amazon and ebay, and circulate your news and promotions exclusively through Facebook and Twitter, as you know none of these will ever be filtered.

It seems Western government's voracity for Internet censorship has increased many fold since the Snowden revelations about digital spying.

Direct Internet censorship was imposed on millions of U.S. government computers blocking them from viewing any material related to the Snowden leak, which at the time of the leak and even now represents a large percentage of all political and technical news stories.

And as John Naughton of the Guardian points out today, the real story about the Snowden leak that everyone is ignoring are the implications on Internet freedom, which he lists as the following:

The first is that the days of the internet as a truly global network are numbered. It was always a possibility that the system would eventually be Balkanised, ie divided into a number of geographical or jurisdiction-determined subnets as societies such as China, Russia, Iran and other Islamic states decided that they needed to control how their citizens communicated. Now, Balkanisation is a certainty.

Second, the issue of internet governance is about to become very contentious. Given what we now know about how the US and its satraps have been abusing their privileged position in the global infrastructure, the idea that the western powers can be allowed to continue to control it has become untenable.

Third, as Evgeny Morozov has pointed out, the Obama administration's "internet freedom agenda" has been exposed as patronising cant. "Today," he writes, "the rhetoric of the 'internet freedom agenda' looks as trustworthy as George Bush's 'freedom agenda' after Abu Ghraib."

As a final note, porn filters already exist for parents in the private marketplace if they choose to use them. So, there is no need for governments to make them mandatory, which indicates that the real agenda behind these new proposed laws is much more about censorship than protecting children.

Religious sites vandalized in Brooklyn

NEW YORK (MYFOXNY) - Police believe they have the man who vandalized several religious-affiliated buildings and statues in the Bay Ridge section of Brooklyn.

Community leaders and politicians gathered Tuesday to denounce the anti-religious vandalism.

Authorities say a statue of Mary at the Church of St. Anselm was painted red sometime Monday night. The vandal also painted other statues throughout Bay Ridge and wrote the word "No" on doors of various churches and a Jewish center.

The NYPD Hate Crimes Task Force was called in Tuesday to investigate the incidents.

Detectives plan to charge the suspect with a hate crime by Wednesday.

A sharia committee in a rebel-held area of Aleppo issued a fatwa deeming croissants ‘haram’ (forbidden in Islamic law) because of their “colonial” significance, pan-Arab daily Asharq al-Awsat reported on Tuesday.

Croissants’ crescent shape celebrates European victory over Muslims, according to the fatwa (religious ruling).

Rebel-controlled areas of the Syrian city have experienced several strict fatwas recently from Islamic sharia committees.

Such edicts are uncommon in Aleppo’s society, which usually adheres to moderate Islamic teachings, Asharq al-Awsat reported.

A sharia committee in the city issued a fatwa on Facebook prohibiting “Muslim women wearing makeup and tight clothes that reveal physical features from going out.”

A fatwa issued by the Council of the United Judiciary, affiliated with the rebel Free Syrian Army, stipulated a year in jail for anyone not fasting during the holy month of Ramadan.

Samir Nashar, a member of the opposition Syrian National Coalition, called on the FSA to unite its forces in Aleppo and work to prevent the expansion of these committees.

There are civil movements resisting the extremist tendencies of such committees, he told Asharq al-Awsat.

Student forgotten in DEA holding cell gets $4.1M

SAN DIEGO — A UCSD student scooped up in a drug raid and left in a Drug Enforcement Administration holding cell for 4 1/2 days without food or water will get $4.1 million to settle his claims, his attorneys announced Tuesday.

Daniel Chong, 25, was among seven people detained in an April 21, 2012, raid on a University City home. Chong, an student at UCSD, was handcuffed and put in 5-by-10-foot cell, by an officer who told him, “Hang tight. We’ll come get you in a minute,” his attorney Julia Yoo said.

The door to the cell was not opened again until April 25. Chong had no food water or toilet facilities during that period and he spent the last two days in darkness, Yoo said.

WASHINGTON — The Senate Select Committee on Intelligence reportedly gave its approval last week to an Obama administration plan to provide weapons to moderate rebels in Syria, but how individual members of the committee stood on the subject remains unknown.

There was no public debate and no public vote when one of the most contentious topics in American foreign policy was decided – outside of the view of constituents, who oppose the president’s plan to aid the rebels by 54 percent to 37 percent, according to a Gallup Poll last month.

In fact, ask individual members of the committee, who represent 117 million people in 14 states, how they stood on the plan to use the CIA to funnel weapons to the rebels and they are likely to respond with the current equivalent of “none of your business:” It’s classified.

Putin Gives North Korea $60 Billion Of Russian Oil, North Korea Uses USA Food Aid To Pay

Russian President Vladimir Putin met with Chinese Vice Premier Zhang Gaoli to prepare the contract with China and North Korea (DPRK) worth an estimated $60 billion (€45.5 bn) to supply China with hundreds of millions of tons of oil.

The unprecedented deal will allow state-owned Russian oil company Rosneft to increase supplies to the region.

As part of the deal, China and North Korea's Kim Jong Un will provide Rosneft Oil with a $2 billion (€1.52 bn) loan, raised from selling unwanted American food aid.

Speaking to the media about the deal, Putin said: "Our exports to the area are expected to amount to a volume of hundreds of millions of tons of oil and in terms of dollars amount to more than $60 billion."

Putin said that he hoped to improve cooperation between Russian energy and tech companies and their North Korean and Chinese counterparts.

In particular, Putin said: "We are especially hopeful with regard to our Chinese partners' prospective co-operation with companies like Gazprom or Novatek."

Commenting, Dear Leader Kim Jong Un of the Democratic Peoples Republic of Korea North Korea, told Victory Over America News that this was a welcome amount of oil and that he was "particularly pleased" that "the starving peasants of the United States would not be getting the oil".
