Trucker sideswiped by Kerry Kennedy gets ticket for leaving accident scene

Rocco Scuiletti could face 15 days in jail if convicted even though it's Robert Kennedy's daughter who's been charged with driving while impaired.

First his truck was hit by Kerry Kennedy. Now he could be looking at a fine or jail time.

Tractor-trailer driver Rocco Scuiletti has been charged with leaving the scene of an accident for not stopping after he was sideswiped by Gov. Andrew Cuomo’s ex-wife.

The charge carries a $250 fine and jail time of up to 15 days.

“It was going to happen sooner or later," Scuiletti, 47, said Thursday of the ticket.

“Even if I believe strongly it was not my fault, I made a mistake by not reporting it."

Scuiletti, who lives in Poughkeepsie, came forward this week to describe how a “nodding off” Kennedy terrorized him on Interstate 684 in Westchester last Friday.

He said she kept swerving her gray Lexus into his lane at 65 mph, slammed into him when he couldn’t get out of the way, then raced off the exit.

Kennedy was charged with impaired driving after telling cops she may have mistakenly taken an Ambien sleeping pill before getting behind the wheel.

After being arraigned Tuesday on a charge of driving while impaired, the mother of three said medical tests showed she wasn’t under the influence of drugs and that a seizure from an old head injury was to blame for her blackout.

Scuiletti said he was glad Kennedy publicly apologized for hitting him and creating a “dangerous situation” but doesn’t buy her excuse.

"Anybody who has a seizure in that manner would not be able to react to a situation,” he said.

“She hit me and she reacted. She was conscious and aware enough to think ‘I just hit someone. I have to hit the gas and get out of here.’"

Kennedy has pleaded not guilty. Even though she says she has never had a booze or pill problem, the court ordered her to get a substance abuse evaluation.
