WASHINGTON – People who fire guns at drones are endangering the public and property and could be prosecuted or fined, the Federal Aviation Administration warned Friday.

The FAA released a statement in response to questions about an ordinance under consideration in the tiny farming community of Deer Trail, Colo., that would encourage hunters to shoot down drones. Benghazi: I Have Not Forgotten

Thursday July 11th marked the ten month anniversary of the terrorist attack that killed four Americans in Benghazi, Libya. I have not forgotten. Nor have I forgotten that’s it’s been 65 days since the last public congressional hearing on Benghazi (Victoria Nuland’s confirmation hearing last week notwithstanding).

I’ve also not forgotten that it’s been 81 days since the five House Committee chairmen who share jurisdiction on the Benghazi attack released their 43-page so-called interim progress report on the investigation. It’s worth noting that the email sent by the House Republican Conference that circulated the report stated: “The Committees intend to fulfill their responsibility to the American people to continue to explore these issues in the weeks and months ahead.” The American people are still waiting for answers.

Similarly, I have not forgotten that Congressman Frank Wolf’s resolution to create a select committee to thoroughly investigate Benghazi has 160 co-sponsors - more than two-thirds of the House Republican caucus and more than enough support to merit a vote on the House floor. Speaker John Boehner and Leader Eric Cantor don’t want a vote because they trust their five committee chairmen to get the job done. The reality is, the committees have enough scandals to manage, and time is running out.

As a former congressional investigator, I realize that public hearings alone do not tell the entire story of a successful or unsuccessful investigation. But in the case of Benghazi over the past two months, at a time when you’d assume an investigation would be hitting its peak heading into August recess, it’s been disappointingly quiet.

I have also not forgotten that we are 61 days from the one year anniversary of the Benghazi attack. Will Congress hold more hearings? Will Congress issue a thorough report? Will the Justice Department and FBI issue an update or return an indictment? Will President Obama be forced to remember? Will anyone be held accountable?

I have not forgotten.

Exerpted from Marine Corps Times: When insurgents attacked the U.S. diplomatic compound in Benghazi, Libya, last fall, Col. George Bristol held a key post in the region. As commander of Joint Special Operations Task Force-Trans Sahara, he was in a position to know what options the U.S. had to protect Americans under fire.

U.S. Ambassador Chris Stevens and three other Americans died in the Sept. 11 attacks, sparking national outcry and a congressional investigation examining the lack of protection. Several U.S. officials have testified before Congress since — but not Bristol, a salty Marine whose task force was responsible for special operations in northern and western Africa.

Defense Department officials have told members of Congress that Bristol cannot be forced to testify because he retired after stepping down during a March change of command ceremony, according to several media reports. The Pentagon reinforced that point of view to Marine Corps Times on Tuesday.

“Col. Bristol was not invited by Congress to testify before he retired,” said Air Force Maj. Robert Firman, a spokesman with the Office of the Secretary of Defense. “The DoD has cooperated fully with Congress and the Accountability Review Board since the beginning of this investigation, and we will continue to do so.”

That isn’t the case, however. While Bristol is preparing for retirement, he is on active duty through the end of July, said Maj. Shawn Haney, a Marine spokeswoman, on Wednesday. He will be placed on the inactive list on Aug. 1, she said. That contradicts statements that Pentagon officials have issued to both Congress and the media.

He looked into the matter, and says his office was told by “trusted sources” that “many, if not all, of the survivors of the Benghazi attacks, along with others at the Department of Defense and the CIA, have been asked or directed to sign additional non-disclosure agreements about their involvement.” He says some of these agreements were signed “as recently as this summer.”

They have been accused in the beating death of Joshua Heath Chellew, 36…

According to the warrant, the four teenagers are accused of starting a fight with Chellew at a Chevron gas station in the 6200 block of Mableton Parkway near Community Drive at about 1:20 a.m. Sunday. They repeatedly punched and kicked him, according to police.

While attempting to escape, Chellew backed into the center five-lane highway and was pushed to the ground and knocked unconscious, the warrant states.

They then walked away from Chellew, “leaving him helpless,” and he was eventually hit by a car, the warrant states.


A horrible, senseless murder. Why hasn’t it received wider attention?

Sex offender, 73, charged in kidnapping and sexual assault of 5-year-old girl

The little girl told police the man approached her as she was going to get her bicycle outside her grandma's house.

"You're pretty and I think I'm going to keep you," the man said.

Harold Leroy Herr, 73, then grabbed the 5-year-old child by her neck, forced her into his car, threatened to kill her unless she "got naked" and listened to him, and sexually assaulted her Thursday, police said.

Herr bought the child chocolate ice cream and dropped her back off in her grandma's Lancaster Township neighborhood a few hours later, police said.

The Conestoga Township man, a convicted sex offender who already served 20 years in prison for an eerily similar assault, now is facing 11 charges in the abduction and rape of the child in Lancaster Township.

The maximum penalty for the charges is more than 100 years in prison.





Lancaster County District Attorney Craig Stedman said, "This is a nightmare case for parents and for everyone in the community.

Anyone who kidnaps a 5-year-old, threatens to kill her and then sexually assaults her, Stedman said, "That is a monster."

Manheim Township police arrested Herr within a day of the kidnapping and sexual assault. Prosecutors immediately began looking at Megan's Law offenders in the area and a city police officer called Manheim Township police and told them about Herr, whom he knew.

Police filed multiple charges, including kidnapping, involuntary deviate sexual intercourse, aggravated indecent assault, indecent assault, unlawful restraint and corruption of minors.

He is being held without bail because of the nature of his case and the threat prosecutors believe he poses to the community.

In an interview with police, Herr denied he was involved in the crime, according to his arrest warrant affidavit. He said he went grocery shopping Thursday, visited a former co-worker at Lancaster County Central Park and bought an ice cream sundae at the same dairy where the little girl said he took her after the assault.

Herr served a 20-year sentence in prison for abducting and raping a 5-year-old girl he picked up off a Lancaster city street in 1989. He lured that child with the promise of buying her ice cream.

In the most recent kidnapping, the girl was taken from an area in the 100 block of Jennings Drive, as she played outside an apartment complex there where her grandmother lives.

The child went around the side of the apartment building to retrieve her bicycle and saw Herr standing there, according to the affidavit.

She said "Hi" to him, and he replied, "Hi," and asked about her bicycle.

That's when he told her she was pretty, and he was going to keep her, and forced her into his car.

Shortly afterward, the man told the child to "be naked right now or I will kill you." He also told her that if she didn't listen, he would kill her, the affidavit said.

The man then parked his car, got into the back seat with the child, took off his pants and sexually assaulted her.

The child was unable to provide an exact sequence of events but told police that, at some point, the man took her to his house and went into a garage there.

He told her he was going to take her to the pool, but the road was closed. Police later learned that roads are closed for paving in the area of the Conestoga Pool, which is not far from Herr's home on Stehman Road.

The man then took her to an ice cream shop and bought her a single scoop of chocolate ice cream.

The child asked if she could go inside the shop, but he told her she could only go inside if she was naked, so she stayed in the car.

Eventually the man took her back to her grandma's neighborhood, the child told police, where they saw police officers.

The man said he "didn't want to be put in jail," and then went down a street and told her to get out of the car. This is where the "boys" found her, she said.

Teens Temar Boggs, 15, and Chris Garcia were riding their bicycles in the area, helping to look for the child during a search involving police, emergency workers and bloodhounds.

They said they saw a man in a maroon car with a little girl, who matched the missing child's description.

They followed the man on their bicycles until he let the little girl out of the car, they said.

Boggs later identified Herr as the man he saw with the child, as well as identified his car.

The girl later identified Herr from a photo of him she saw in the Sunday News. She also identified his car and cane, from photos of them, and also indicated that Pine View Dairy was where he took her for ice cream, after police took her for a drive to try to figure out where the suspect took the child.

Manheim Township police began watching Herr's home Friday. Southern Regional police arrested him on the Megan's Law registration violation.

Herr was charged with failing to appear at a Megan's Law registration site within a 10-day period. He has been in jail, on $200,000 bail, for that offense.

Stedman and Manheim Township police Chief Neil Harkins thanked the public for their help in the case, particularly the two teens.

"These are the kind of crimes that do enrage our community," Stedman said.

"It's haunting," he said. "It's terrible."

Stranger abductions are rare, Stedman and Harkins said. But they do happen.

"We encourage and urge parents to be vigilant," Stedman said. "Incidents like this are reminders of how things can change in a moment."

In Herr's case, Stedman said he believes the crime was premeditated.

"He wasn't out there to talk to someone about philosophy," he said. "He was out there looking for a little girl ... and he took one."

In his prior case, Herr was sentenced to 5 to 20 years in prison in May 1990 after pleading guilty in Lancaster County Court to kidnapping the girl from South Prince Street and raping her in a cornfield in July 1989.

In May 1999, Herr was paroled to a community corrections center. Herr was released in July 2001.

He then violated parole terms, by possessing photographs of minor children, and was returned to prison in September 2001, according to court records.

Herr came up for parole review six more times, but the board refused to parole him. He served his maximum sentence and was released in May 2010.

Among the reasons the board cited in refusing to re-parole Herr was that he minimized the nature and circumstances of his crime, and reports and assessments concerning his behavioral and mental condition reflected an "ongoing risk to the community."

Stedman said the judicial system did all it could to keep Herr behind bars for as long as possible.

Perhaps it is time to consider longer prison sentences for sexual predators, he said, adding that no punishment seems long enough to make up for what happened to Herr's most recent victim.

Illinois gun group asks: "Will Mary Shepard be defenseless at work again?"

Why would Senator Dan Kotowski (D-Park Ridge) want this woman to be defenseless, the Illinois Gun Lobby asked Tuesday morning while reviewing Senator Kotowski's call to ban concealed weapons in churches. Sen. Kotowski's proposal would add another location to the list of places where Illinois' citizens with concealed carry weapon permits will be defenseless.

Mary Shepard, who had a permit to carry in Utah and Florida, was unable to protect herself at work when she and an 83-year old colleague were attacked in 2009. Ms. Shepherd was at work - her local church in downstate Anna - when a six-foot-three-inch, 245 pound man with a violent past and a criminal record entered the building and attacked them. Ms. Shepard and her co-worker survived with major injuries to the head, neck and upper body. Ms. Shepard’s injuries required extensive surgeries and a long recovery.

Illinois' law against right-to-carry was why Ms. Shepherd suffered without defense, the NRA argued on her behalf in court. That argument led to federal courts forcing Illinois to grant its citizens their constitutional right to bear arms.

“The Second Amendment guarantees an individual right to keep and bear arms and the right to self-defense,” said NRA-ILA Executive Director Chris W. Cox. “The state of Illinois’ severe and irrational restriction on self-defense is an abettor in the terrible attack on Ms. Shepard and her co-worker."

Monday, Senator Kotowski and the Protestants for the Common Good held a press conference calling for a ban on carrying concealed weapons to church - a measure, if enacted, would cause Ms. Shepard to lose hope of ever being able to protect herself at work.

TIMELINE: How the 1991 Crown Heights riots unfolded
A station wagon driven by Yosef Lifsh, hit another car and careened onto the sidewalk at 8:21 p.m. Monday, August 19, 1991.

Lifsh was part of a three-car motorcade carrying the now-deceased spiritual leader of the Lubavitcher Hasidic community, Rabbi Menachem Schneerson, home from a weekly police-escorted visit family at their Queens gravesites.

The station wagon crushed two black children, 7-year-old cousins Gavin and Angela Cato.

Within minutes, an ambulance from the Hasidic-run Hatzolah ambulance service and two from the city's Emergency Medical Service arrived.

An angry crowd gathered. Cops radioed for backup, reporting that the station wagon driver and passengers were being assaulted. Officer Nona Capace ordered the Hatzolah ambulance to remove the Hasidic men from the scene.

The children went by separate city ambulances to Kings County Hospital. Gavin Cato was pronounced dead; his cousin survived. A rumor quickly spread that the Hatzolah ambulance crew had ignored the dying black child in favor of treating the Jewish men.

Ignited by the false story, resentments exploded into violence. Groups of young black men threw rocks, bottles and debris at police, residents and homes.

Five blocks away from the crash scene, at 11:20 p.m, 29-year-old Australian scholar Yankel Rosenbaum was attacked by a dozen or more black youths. He was stabbed four times. Cops quickly collared Lemrick Nelson, 16, who was identified by Rosenbaum as his attacker.

Rosenbaum was expected to recover. Mayor David Dinkins, New York's first black mayor, visited the hospital bed. But by 2:30 Tuesday morning, the Australian was dead because the Kings County staff overlooked one of the knife wounds.

Street violence raged for three days. On Thursday, cops finally restored order. Ultimately, 43 civilians and 152 police officers were injured.

After several trials, Lemrick Nelson was eventually convicted of violating Rosenbaum's civil rights and sentenced to 10 years in prison.

Despite living side by side, Hasidic Jews, African Americans, and people from the Caribbean in Crown Heights, Brooklyn, New York, rarely socialized before 1991. The groups occupied separate cultural worlds, and a climate of mutual suspicion and tension prevailed. On 19 August 1991, after a Jewish driver tragically killed a young black child, Gavin Cato, anti-Semitic violence erupted, and African Americans attacked Jews, Jewish property, and city police. Later that evening a mob of about fifteen African Americans shouting "Kill the Jew" attacked Yankel Rosenbaum, a native of Australia. Bearded and wearing a yarmulke, Rosen-baum was beaten and stabbed, but before he bled to death he identified his assassin as sixteen-year-old Lemrick Nelson. Three more days of rioting ensued.

Nelson was acquitted of murder in a state court in 1992, and he later celebrated his acquittal with some of the jurors. In 1994 the federal government charged Nelson and Charles Price, who was accused of inciting the attack, with violating Rosenbaum's civil rights. Convicted as an adult, an unrepentant Nelson received 235 months in prison, while Price received 260 months. New York City then settled a lawsuit by several Crown Heights residents for $1.1 million.

The official state report on the riots criticized New York City Mayor David Dinkins for his inaction during the riots; Dinkins later lost his 1993 reelection bid to Rudolph Giuliani. Community leaders, a community mediation center, and numerous community groups subsequently sponsored integrated activities in efforts to reduce cultural divisions in Crown Heights.
