According to Ed Morissey of Hotair.com, the Martial Law EO that came out on Friday is similar to the one that Clinton passed in 1994 and is not an expansion of powers.
However, according to Jay Sekulow of ACLJ, there is a much broader definition of national defense.
Both EO’s are contained in the body of this article and you can compare them for yourself.
Obama’s EO reflects the differences in the government agency structure which has changed considerably since 1994. For instance, we now have a DHS and this EO reflects that. Also, 10 references to FEMA have been removed.
The concern about the EO being implemented during peacetime has also been mentioned but the word “peacetime” was only used once more than in Clinton’s Martial Order.
Obama did not alert people to the EO, it came out with the Friday dump, and the language is vague which lead to many concerns that it was an expansion of Executive powers.
It is possible that the EO could be misused, but for now, it is not a problem.
The concern was fueled in part by new laws, such as NDAA which allows for U.S. citizens to be arrested and detained indefinitely as terrorists, and by proposed treaties that cede our natural resources to the U.N.
The biggest problem is that Obama is an ideological far left Progressive zealot and not the more pragmatic Bill Clinton. No one worried that Bill Clinton was going to manufacture a crisis to assume control over the nation’s resources.
The biggest problem for me is that Podesta via The Center for American Progress has told Obama to rule by circumventing Congress with EO’s and overreaching government agencies, which Obama has done to excess.It is not solely Podesta saying this either.
The EO does allow Obama to nationalize everything but we should be comforted (I think) to know Clinton could have done the same thing and it has been the case since 1950. The fact that Obama does rule by EO’s and agencies makes this more significant than in the past as does the overly vague definition of national defense.
