As former Solicitor General for the Obama Administration, Supreme Court Justice Elena Kagan was intimately involved in the passage of ObamaCare and cannot be an impartial judge when ObamaCare comes before the Supreme Court.
Kagan wrote to Harvard Law Professor Laurence Tribe in an email just before the passage of ObamaCare, “I hear they have the votes, Larry!! Simply amazing.”
This is the tone of a partisan cheerleader for ObamaCare, NOT a Supreme Court Justice. Kagan should NOT be deciding the constitutionality of ObamaCare.
