Health and Human Services Secretary Kathleen Sebelius testified before the House Education and Workforce Committee last week about the contraception mandate her agency has imposed on religious institutions. Her responses to questions on the constitutionality of the mandate would have been laughable if this wasn’t such a serious issue. She hadn’t a clue about any legal precedents when it comes to religious freedom. She said she tried to find a balance between religious liberty and the mandate, but “I’m not a lawyer, and I don’t pretend to understand the nuances of the constitutional balancing tests.”
Here’s the video of Rep. Trey Gowdy (R-SC) questioning Sebelius, who made a complete fool of herself. In short, no thought was given to the constitution – not when Obamacare was passed, and not when these mandates were enacted.
