BALLSTON SPA — A grand jury has indicted the man accused of trying to rape and kidnap an elderly woman last month in downtown Saratoga Springs, the county’s top prosecutor said Monday.
Saratoga County District Attorney James A. Murphy III said Antonio Lopez-Bautista, 18, of South Federal Street in Saratoga Springs was in the country illegally when he allegedly pulled a 67-year-old woman from her car near Congress and South Franklin streets in the early morning hours of May 22 and began assaulting her.
The woman defended herself and called for help, prompting someone who lived nearby to call police. Officers located Lopez-Bautista hiding in nearby bushes and arrested him, booking him on felony charges including second-degree attempted kidnapping, first-degree attempted rape and second-degree assault.
A grand jury heard evidence in the case and indicted Lopez-Bautista on those charges Monday. The grand jury also returned new charges of first-degree assault, first-degree robbery, second-degree robbery and first-degree sexual abuse, Murphy said.
