Innocent Until Proven Guilty Labeled A "Loophole" In N.M. Rape Case Agaist Gunshop Owner

A New Mexico father is scared and angry.  The man accused of raping his daughter is out on his own recognizance and he's legally allowed to continue operating his Rio Rancho gun shop.
Andrew Davis was indicted by a grand jury last month on four counts of criminal sexual penetration of a minor age 13 to 18.  At his most recent hearing, he pleaded not guilty and the judge allowed him to continue operating Bulldog Firearms, despite the criminal case.  His attorney found the legal loophole in federal statute 18 USC Sec. 925 B.
But now the father of the plaintiff says he is afraid Davis will harass his daughter, and he says they have no legal protections.
"You deal with it initially, and it almost becomes an issue on paper so it's a little better to deal with, and then you have to relive this process over and over again that brings the anger out," the father said.
The plaintiff's attorney is pushing for Davis to be on an ankle monitoring device while this case plays out, but another hearing for Davis has not been scheduled yet.

...and so the truth keeps coming. My daughters civil suit was won by a unanimous jury on 4/9/2019. Libel/slander/defamation etc. This against the lies told by Andrew Davis, his wife Carly..their decade long fabrication of lies is coming undone. My daughter and I will also be setting up an account to help other potential victims come forward. Our silence was proper and necessary in the face of the almost unbelievable amount of lies, false accusations and slander suffered at the hands of these people. It is STILL not over. The public would do well to very carefully evaluate their interactions with these people. The truth will keep coming out, and it is sordid.
