A McAllen high school student is facing criminal charges after being accused of having sex with an underage student on campus.
McAllen ISD police arrested 20-year-old Osvaldo Belmontes on a sexual assault of a child charge late Wednesday afternoon.
Court records show that the incident happened at Rowe High School off Ware Road just before 5 p.m. Wednesday.
The records show that a surveillance camera monitor saw Belmontes and another student engaging in a sexual act.
A police officer found Belmontes and the 16-year-old student walking away from the area.
Officers reviewed the security footage, which allegedly confirmed the two having sex.
Belmontes appeared before Hidalgo County Justice of the Peace Homer Jasso in Edinburg on Thursday afternoon where he was issued a $25,000 personal recognizance bond.
Hidalgo County Jail records show that Belmontes was turned over to the custody of U.S. Immigration & Customs Enforcement (ICE) agents.
McAllen iSD issued the following statement about the incident:
"Anytime students are on school grounds they are subject to the Student Code of Conduct. Federal privacy laws forbid us from releasing any details on student discipline. With the safety of students in mind, McAllen ISD takes these matters seriously and will deal with them based on established procedures and protocols."
