(FLAT ROCK, MI) The Department of Justice announced today that a seventh defendant, who was in the United States illegally, has been charged in the death of U.S. Border Patrol Agent Brian Terry. Rosario Rafael Burboa-Alvarez was indicted by a federal grand jury in Tucson yesterday, becoming the seventh man charged in connection with the murder of U.S. Border Patrol Agent Brian Terry.
The indictment charges Burboa-Alvarez and others with first degree murder, second degree murder, conspiracy to interfere with commerce by robbery and attempted interference with commerce by robbery. Burboa-Alverez, who was already in custody on immigration related charges, will appear in federal court in Tucson, Arizona, today.
Ralph Terry, Brian Terry’s uncle and President of the Brian Terry Foundation said, “While we are grateful another arrest has been made the fact that the suspect was in our country illegally is a sad and in this case deadly reminder that our border is not secure.”
Burboa-Alvarez is described in the indictment as the recruiter who assembled the crew of armed robbers to travel from Mexico to the United States and forcibly take marijuana from smugglers through threats or actual violence. Ultimately, it was this group that encountered Brian Terry and his team of elite Border Patrol Tactical Team (BORTAC). The ensuing violent firefight between the rip crew and the agents near Peck Canyon, Arizona, resulted in Brian's death.
Three months later, ATF whistle blowers came forward to reveal that the men that killed Brian were carrying state of the art assault weapons supplied to them by ATF in gun trafficking investigation gone-wrong known as Operation Fast & Furious.
Despite the positive developments in the criminal case, the Terry family continues to be critical of the Department of Justice. Josephine Terry, Brian's mother, said, "If I had to give a report card grade to Eric Holder, he would get an A with respect to his department's prosecution of Brian's killers; but I would give him an F for his efforts in holding those ATF and DOJ employees accountable for the many mistakes made in Operation Fast & Furious."
Mrs. Terry went on to say, "Although my family continues to be frustrated with the lack of accountability in the Operation Fast & Furious scandal, this latest development in the criminal investigation is truly momentous. Since day one, we have asked that investigators pursue not only Brian's killers, but the people and the organization that put that rip crew together and supplied them assistance.
This is another step in the right direction."

Agent Terry, a member of the U.S. Border Patrol’s elite tactical unit known as BORTAC, was on duty when he was shot to death while tracking members of a suspected drug cartel rip crew on December 14th, 2010 near Rio Rico, AZ.
