Measure Challenges Municipal Firearms Ordinances

HARRISBURG – Legislation allowing a person or member organization to legally challenge a municipal firearms ordinance was passed by the state House Judiciary Committee. House Bill 2011 also allows reimbursement for the cost of the civil action. Local governments have been passing ordinances regulating firearms in defiance of the state’s Crimes Code, resulting in confusion for gun owners who don’t know they are breaking the law. The end result is that citizens can be forced to incur significant expenses to challenge the illegal and unconstitutional ordinances. The measure would amend the Crimes Code by providing remedies for the unlawful regulation of firearms and ammunition. It would establish that anyone adversely affected by a municipal gun ordinance may seek injunctive and declarative relief, as well as damages, which are defined as “reasonable expenses,” including attorney fees, expert witness fees, court costs and loss of income. House Bill 2011 will next be considered by the full House.
